1. Acceptance of Terms

By accessing or using the Shadow Lotus website (shadowlotusos.polsia.app) or purchasing any of our products, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use our site or purchase our products.

These terms apply to all visitors, customers, affiliates, and anyone else who interacts with Shadow Lotus services.

2. Digital Products

Shadow Lotus sells digital products — PDFs including journals, card decks, worksheets, and planners. All products are delivered digitally via download link. There is no physical shipping involved unless otherwise explicitly stated.

You are responsible for having the technical means to open, download, and print PDF files. We are not responsible for incompatibility with your devices, software, or printer. Standard PDF readers (Adobe Acrobat, Preview, Chrome PDF viewer) are freely available and work with all our products.

Products are print-ready PDFs. They are not physical items. You print them yourself. You are responsible for printing costs, materials, and binding if you choose to bind them.

3. License & Permitted Use

When you purchase a Shadow Lotus product, you receive a personal, non-exclusive, non-transferable license to download, print, and use the product for your own personal, non-commercial purposes.

You MAY:

• Download the PDF to your personal devices
• Print the product as many times as you need for your own personal use
• Use the product privately — journal with it, work through it, display it in your personal space
• Print a single copy as a personal gift for one individual (not for resale)

You MAY NOT (without explicit written permission):

• Resell, sublicense, or distribute any Shadow Lotus product in any form — digital or physical
• Sell printed copies of our products
• Use our products in any commercial context (workshops, retreats, clinics, subscription boxes, etc.)
• Modify, adapt, translate, or create derivative works based on our products
• Share download links, files, or printed copies with groups, mailing lists, or platforms
• Post our products to file-sharing sites, torrent trackers, or social media
• Include our products in AI training datasets

For commercial licensing inquiries (workshops, clinics, etc.), contact us. We're open to reasonable arrangements.

4. Prohibited Uses

In addition to the licensing restrictions above, you agree not to:

• Use our website or products for any unlawful purpose
• Impersonate Shadow Lotus, its employees, or other users
• Attempt to gain unauthorized access to any part of our systems
• Interfere with the proper functioning of our website
• Harvest, scrape, or collect other users' information
• Submit false, fraudulent, or misleading information (including in affiliate applications or reviews)
• Use automated bots to interact with our site

5. Refund Policy

Digital products are generally non-refundable once downloaded or accessed. This is consistent with standard industry practice for digital goods — once a file is delivered to you, we have no way to "take it back."

Exceptions

We will issue a full refund if:

• The file is corrupted or cannot be opened
• The product delivered is materially different from what was described on the product page
• You accidentally purchased the wrong product and contact us within 24 hours of purchase, before downloading
• A duplicate charge occurred due to a technical error

We will not issue refunds because you changed your mind, didn't use the product, didn't like it, or it didn't solve your emotional problems. (We're a digital goods store, not a therapist.)

To request a refund, contact us with your order details within 7 days of purchase.

Gift cards: Unspent gift cards may be refunded within 14 days if unused. Once redeemed, the portion spent on a product is subject to the standard no-refund policy.

6. Subscription Terms

Our subscription box is a recurring monthly charge. By subscribing, you authorize us to charge your payment method on a monthly basis until you cancel.

• Billing cycle: Monthly, on or around the date you first subscribed
• Content: One digital bundle per month, delivered by the 1st of each month. Exact contents are at our discretion.
• Cancellation: You may cancel at any time. Cancellation stops future billing. You retain access through the end of the current billing period. No pro-rated refunds for partial months.
• Price changes: We will provide at least 30 days notice of any price increase before charging you the new rate.
• Failed payments: If a payment fails, we will attempt to retry the charge. After multiple failures, your subscription will be suspended. You can reactivate by updating your payment method.

To cancel, use the link in your subscription confirmation email or contact us.

7. Gift Card Terms

• Gift cards are valid for purchases on shadowlotusos.polsia.app only
• Gift cards have no expiration date
• Gift cards are not redeemable for cash
• Lost or stolen gift card codes are not replaceable — treat them like cash
• Gift cards cannot be used to purchase other gift cards
• If your purchase total exceeds the gift card value, you must pay the difference with another payment method
• Unused gift card balances cannot be transferred between cards
• Shadow Lotus is not responsible for gift cards sent to an incorrect email address provided by the purchaser

8. Affiliate Program Terms

Participation in our affiliate program is subject to approval and these additional terms:

• Disclosure: You must clearly disclose your affiliate relationship in all promotions, as required by FTC guidelines. Language like "I earn a commission if you buy through my link" is sufficient.
• Prohibited promotion methods: No spam, no misleading claims, no paid search bidding on our brand name, no cookie stuffing, no coupon sites without our approval.
• Commission eligibility: Commissions are earned on completed, non-refunded purchases. Commissions on refunded orders are reversed.
• Minimum payout: $25. Payments are made monthly for balances above the minimum.
• Self-referral: You may not earn commissions on your own purchases or purchases by immediate family members.
• Termination: We reserve the right to terminate any affiliate account for violation of these terms, suspected fraud, or at our discretion with 30 days notice.
• Outstanding commissions: Legitimate earned commissions will be paid out within 60 days of account termination.

9. Accounts & Email

Shadow Lotus does not require account creation for purchases. We identify customers by email address for order lookups, download access, and affiliate tracking.

You are responsible for keeping your email address accurate. We cannot be responsible for undelivered downloads or communications due to an incorrect email address you provided.

You may request deletion of your data at any time. See our Privacy Policy for details.

10. Disclaimer of Warranties

Shadow Lotus products and services are provided "as is" and "as available" without any warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Shadow Lotus is not a mental health provider, therapist, or medical professional. Our products are creative and journaling tools, not clinical treatment. Nothing in our products, blog, quiz, or communications constitutes mental health advice, diagnosis, or treatment. If you are in crisis, please contact a qualified mental health professional or crisis line.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Shadow Lotus and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products or services.

Our total liability to you for any claims arising from these terms or your use of our products will not exceed the amount you paid for the specific product(s) at issue.

Some jurisdictions do not allow limitation of liability for certain types of damages — in those jurisdictions, the limitation applies to the fullest extent permitted by law.

12. Intellectual Property

All Shadow Lotus content — products, website design, text, graphics, logos, the raccoon mascot, and all other materials — are the property of Shadow Lotus and are protected by copyright and other intellectual property laws.

The name "Shadow Lotus," the lotus flower logo, and associated brand elements are trademarks of Shadow Lotus. You may not use these without written permission.

If you believe any content on our site infringes your copyright, contact us with the details and we will respond promptly.

13. Governing Law

These Terms of Service are governed by the laws of the State of North Dakota, without regard to its conflict of law provisions. Any disputes arising from these terms will be resolved in the state or federal courts located in Minot, ND, and you consent to personal jurisdiction there.

If any provision of these terms is found unenforceable, the remaining provisions continue in full force.

14. Changes to These Terms

We reserve the right to update these Terms of Service at any time. We will post updated terms on this page with a new effective date. For material changes, we will notify customers via email.

Your continued use of our site or products after changes to these terms constitutes your acceptance of the new terms.
